Terms of Service

These Terms of Service (the “Terms”) are a binding agreement between you and Airfive, Inc., doing business as ResumAid (“ResumAid,” “we,” “us,” or “our”). They govern your access to https://resumaid.ai and the resume-building, analysis, editing, storage, payment, and related services we provide (collectively, the “Services”). By accessing or using the Services, you agree to these Terms. If you use the Services for an organization, you represent that you can bind that organization to these Terms.

You must be at least 18 years old and legally capable of entering into a contract. You may not use the Services if applicable law prohibits you from doing so. The Services are not directed to children under 13, and we do not knowingly collect their personal information.

We may update these Terms from time to time. Material changes will take effect after reasonable notice when required by law. Your continued use after the effective date of revised Terms constitutes acceptance of the revised Terms.

ResumAid uses automated systems, including artificial intelligence, to analyze information you provide and generate resume drafts, match assessments, suggestions, and related content. The Services may process uploaded resumes, job descriptions, and content available at links you submit.

The Services are tools for drafting and organization. They are not employment, recruiting, legal, financial, immigration, or career-placement services. We do not guarantee that any score is definitive or that using the Services will result in an interview, offer, promotion, or other outcome.

AI-generated content can be incomplete, inaccurate, outdated, or unsuitable. Match percentages are estimates based on the available job requirements and evidence in the materials you provide; they are not an employer's assessment or a promise of eligibility. You must review every output before using or submitting it and remain solely responsible for its accuracy, completeness, legality, and suitability.

You must not present invented experience, credentials, achievements, dates, metrics, or other false information to an employer. ResumAid may attempt to avoid unsupported claims, but you are responsible for confirming every statement in your final resume.

You must provide a valid email address and keep access to that email account secure. Email sign-in links are personal to you. You are responsible for activity under your account and must promptly notify us through the contact method available on the Site if you suspect unauthorized access.

You may not share, sell, or transfer your account; circumvent free-use, plan, identity, email, device, or network limits; create multiple accounts to avoid charges or restrictions; automate access without our permission; scrape or reverse engineer the Services; interfere with security or operation; introduce malicious code; use the Services unlawfully; or use outputs to deceive, discriminate, harass, or infringe another person's rights.

We may use reasonable technical measures, including account, device, and network information, to enforce limits and prevent fraud or abuse. We may throttle, suspend, or terminate access when we reasonably believe these Terms, a plan limit, or applicable law has been violated.

“Your Content” includes resumes, files, text, answers, job postings, links, and other material you submit. You retain ownership of Your Content. You grant ResumAid and its service providers a worldwide, non-exclusive, royalty-free license to host, copy, transmit, parse, display, modify, and otherwise process Your Content only as reasonably necessary to provide, secure, support, and improve the Services, comply with law, and enforce these Terms.

You represent that you own or have permission to submit and process Your Content, including content at URLs you ask us to access. You may not upload another person's resume or personal information without authorization. Do not submit Social Security numbers, government identification numbers, financial account or payment-card data, health information, passwords, or other information not reasonably needed to prepare a resume.

Third-party websites control whether their content can be accessed. We do not guarantee that a submitted link can be read or that third-party content is accurate or available. You are responsible for complying with the terms and rights applicable to each source you submit.

ResumAid and its licensors own the Services, software, interface, branding, templates, documentation, and related intellectual property. Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable right to use the Services.

As between you and ResumAid, you may use and own your final resume and other generated output to the extent permitted by applicable law. Because AI systems may produce similar content for different users, we do not promise that generated content is unique or eligible for copyright protection. No rights in the underlying Services, software, models, templates, or branding are transferred to you.

If you send feedback, you grant us a perpetual, worldwide, royalty-free right to use it without restriction or compensation, provided we do not identify you publicly without permission.

Prices are shown in U.S. dollars unless stated otherwise. Applicable taxes may be added at checkout. Payment processing is handled by a third-party payment processor, and its terms and privacy practices apply to payment information. We do not store full payment-card numbers.

A one-time purchase provides the stated number of additional resume generations. Annual plans are billed in advance and automatically renew for successive one-year terms at the then-current price unless canceled before the renewal date. The Pro plan includes up to 30 resume generations per month; unused monthly capacity does not roll over. Unlimited plans are subject to these Terms and reasonable-use safeguards against automated, shared, abusive, or non-personal use.

You may cancel an annual plan at any time using the cancellation method made available in your account or through the contact channel shown on the Site. Cancellation stops the next renewal, and access continues through the paid term. Except where required by law, purchases are final, charges already paid are non-refundable, and we do not provide prorated refunds or credits for unused time or capacity. Failed or reversed payments may result in suspended access.

We may change future prices or plan features. Price changes for an existing subscription apply no earlier than its next renewal after any notice required by law. Promotional offers may have additional stated terms.

We process account details, usage information, uploaded materials, and generated resumes to operate, secure, analyze, and improve the Services. We may use hosting, authentication, analytics, payment, file-processing, and AI service providers to perform these functions. Those providers may process Your Content on our behalf under their applicable agreements.

You should keep your own copy of every important resume. We do not promise permanent storage, and content may be deleted after account closure, prolonged inactivity, expiration of applicable retention periods, or as needed for security or legal compliance. No method of storage or transmission is completely secure.

The Services may link to, retrieve content from, or rely on third-party websites and services. We do not control or endorse them and are not responsible for their availability, accuracy, content, security, terms, or practices. Your use of a third-party service is governed by your agreement with that third party.

You may stop using the Services at any time. We may suspend, limit, or terminate your access if you breach these Terms, fail to pay, create risk or possible legal exposure, misuse the Services, engage in fraud, or if continued operation is no longer commercially practical. Where reasonable, we will provide notice and an opportunity to cure.

Upon termination, your license to use the Services ends. Provisions that by their nature should survive—including ownership, payment obligations, disclaimers, limitations of liability, indemnification, and dispute provisions—will survive. We may retain information as required by law, for legitimate business purposes, or to prevent fraud and abuse.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES AND ALL OUTPUTS ARE PROVIDED “AS IS” AND “AS AVAILABLE.” RESUMAID DISCLAIMS ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, AND ANY WARRANTY ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.

WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF HARMFUL COMPONENTS; THAT INPUTS OR OUTPUTS WILL BE STORED OR RECOVERABLE; OR THAT ANY RESUME, MATCH SCORE, RECOMMENDATION, THIRD-PARTY CONTENT, OR RESULT WILL BE ACCURATE, UNIQUE, COMPLETE, OR ACCEPTED BY AN EMPLOYER OR AUTOMATED SCREENING SYSTEM.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, RESUMAID, AIRFIVE, INC., AND THEIR AFFILIATES, OFFICERS, EMPLOYEES, CONTRACTORS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, BUSINESS, OPPORTUNITY, GOODWILL, DATA, EMPLOYMENT OPPORTUNITIES, OR USE, ARISING OUT OF OR RELATED TO THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID RESUMAID DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) US$100. These limitations apply regardless of the theory of liability and do not limit liability that cannot legally be limited.

To the extent permitted by law, you will defend, indemnify, and hold harmless ResumAid, Airfive, Inc., and their affiliates, officers, employees, contractors, licensors, and service providers from claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from Your Content, your submitted links, your use or misuse of the Services or outputs, your violation of these Terms or law, or your infringement of another person's rights. We may control the defense of an indemnified claim, and you agree to cooperate.

Before filing a claim, you and ResumAid agree to try in good faith to resolve the dispute informally for at least 30 days after written notice describing the claim and requested relief. Notices to ResumAid may be sent through the contact channel shown on the Site. Nothing in these Terms prevents either party from seeking relief in small-claims court where eligible or requesting urgent injunctive relief to protect intellectual property, security, or confidential information.

These Terms are governed by the laws applicable in the jurisdiction where Airfive, Inc. has its principal place of business, without regard to conflict-of-law rules, except to the extent the laws of your place of residence require otherwise. Any court proceeding must be brought in a court of competent jurisdiction, and each party consents to personal jurisdiction there. Mandatory consumer rights remain unaffected.

We are not liable for delay or failure caused by events beyond our reasonable control, including internet or utility failures, labor disputes, natural disasters, government action, cyberattacks, or failures of third-party providers. We may assign these Terms in connection with a merger, acquisition, reorganization, sale of assets, or by operation of law. You may not assign them without our written consent.

These Terms and any additional terms presented for a particular feature or purchase are the entire agreement between you and us regarding the Services. If a provision is unenforceable, it will be modified to the minimum extent necessary and the remainder will stay in effect. Our failure to enforce a provision is not a waiver.
